Conditions for participation in HotMiles Business Events


1. Scope of application

1.1 Participating in our bonus programme ‘HotMiles Business Events’ will give you have the opportunity to acquire and redeem bonus points in the bonus programme of H-Hotels.com (from no on ‘HotMiles’) by booking venues and blocks of rooms for conferences and meetings in our participating hotels. A list of all participating hotels can be found at https://www.h-hotels.com/en/hotmiles/participating-hotels. Your contract partner for HotMiles is My H-Hotels GmbH, Braunser Weg 12, 34454 Bad Arolsen.

1.2 Participation in HotMiles Business Events is subject exclusively to the following conditions.

2. Prerequisites for participation

2.1 Participation is free.

2.2 There is no legal claim to participate in HotMiles Business Events. 

2.3 You must have an access account for HotMiles Business Events (from no on ‘Access Account’) to collect and redeem HotMiles. Registration is reserved for employees or representatives of legal entities, partnerships having legal capacity, or sole proprietorships (from no on ‘Company’). 

2.4 Before you participate in our HotMiles Business Events programme, the conditions for participation named under item 6 must be fulfilled, and you must confirm this by issuing an appropriate declaration when you register.

3. Enrolling in the programme

3.1 You must set up an account to participate in HotMiles Business Events, which you can do via our website, www.h-hotels.com. As an applicant, you are the contract partner for our bonus programme ‘HotMiles Business Events’. An account cannot be set up anonymously. You must disclose all mandatory information in the registration process, especially the name and address of the company, your full name as well as email address. For HotMiles Business Events, you must additionally confirm that you fulfil the conditions to participate in the programme. This information is subject to the data protection regulations under item 11 of these conditions of participation.

3.2 A Company can set up multiple accounts if this is done through different applicants. The applicant for an existing account may not be replaced.

4. Credit vouchers from HotMiles

4.1 As part of our HotMiles Business Events programme, HotMiles can be acquired in all participating hotels, based on the gross revenue attained from you that is eligible for a rebate. For sales made in Euros, one HotMile will be credited for each Euro of the gross turnover via the respective account, and for revenues in Swiss Francs, one HotMile per Swiss Franc of the total turnover. HotMiles will be calculated based on the entire gross invoiced amount, rounded down to complete euro amounts or complete Swiss Francs. Other currencies cannot be used to acquire HotMiles at this time. 

4.2 HotMiles following item 4.1 can be acquired for bookings of conference rooms, as well as several rooms for meetings and conferences via the respective account only. HotMiles can be purchased via HotMiles Business Events only if the direct booking is made on account of the Company and if the HotMiles Business Events ID is disclosed. HotMiles cannot be acquired for brokering third-party bookings. 

4.3 If you wish to collect HotMiles for the booking, you must disclose this when the booking is made, it cannot be considered later. 

4.4 HotMiles will grant the credit within four weeks after complete payment has been made.

4.5 You will acquire no HotMiles for any booked or conference rooms that remain unused even if you are billed for them. 

4.6 The number of HotMiles you have collected can be viewed online via your account for HotMiles Business Events. 

4.7 HotMiles will grant the credit to the benefit of the Company you specified when you registered for HotMiles Business Events. You will manage the HotMiles as the applicant for the Company. 

4.8 If a Company has multiple HotMiles Business Events accounts for different applicants, HotMiles will grant credit separately for each account. HotMiles collected via different accounts will not be added up and must be redeemed independently following item 5.

5. Redeeming HotMiles

5.1 HotMiles can be redeemed for overnight stays as soon as the account shows enough credit to completely cover for the expenses. The number of HotMiles needed for this can be found in your protected login area. This offer is subject to availability and cannot be combined with other promotions.

5.2 HotMiles must be redeemed online via our website, www.h-hotels.com, by using the appropriate account.  

5.3 HotMiles can be redeemed only for overnight stays. Cash payments cannot be claimed.  

5.4 If you redeem HotMiles to pay an entire invoiced amount, that amount will not entitle you to any new HotMiles. If you redeem HotMiles to pay part of an amount invoiced for venues as well as rooms booked for meetings and conferences, you will receive new HotMiles only for the invoiced amount remaining after the redemption, which must be settled through an additional payment. You will not receive any new HotMiles as part of our HotMiles Business Events programme, for paying services other than those under item 4.2.

6. Private use of HotMiles

6.1 As the applicant, you are responsible for informing your employer or client about the application, and advantages offered by using the HotMiles Business Events programme. You may make personal use of the HotMiles credited via the account set up by your employer or client, as long as the Company for which the registration was made consents to such use, and the use occurs within the scope of statutory provisions and the Company’s in-house guidelines.

6.2 You must inform us about any changes to those circumstances.

7. Transferability

The HotMiles cannot be transferred to third parties by way of a legal transaction. They can be redeemed only by the Company or the applicant and other employees following the conditions in item 6.

8. Expiration of HotMiles

HotMiles will expire if you fail to redeem them on or before 31 December following the year of their acquisition.

9. Misuse by third parties

If you suspect unauthorised third parties are misusing the account, you must inform us without delay. We will not be responsible for any damage incurred if you neglect tor delay to notify us. We will be liable only per liability regulations mentioned under item 10.

10. Liability

10.1 For any damage that occurs in connection with your participation in HotMiles Business Events, we will be liable only if and to the extent that we, our legal representatives, employees, or other vicarious agents acted with intent or gross negligence; or that the damage is based on the culpable breach of material contractual obligations. A contractual obligation is ‘material’ if it makes proper contract execution possible in the first place, and you as a participant normally rely and may normally rely on its being complied with. If material contractual obligations are breached based on slight negligence, liability for property damage and financial loss will be limited to foreseeable damage that is typical of this type of contract.

10.2 Liability for culpable injury to life, limb or health, and compulsory liability under the provisions of the German Product Liability Act remain unaffected.

10.3 Further liability based on damage other than that provided for in this item 12 is excluded.

11. Data privacy

We will collect, process and use the data connected with participation in order to implement HotMiles Business Events. It includes, but is not limited, to the data you disclose when registering and during your participation (master data) as well as the data accrued in connection with your participation, primarily when collecting and redeeming HotMiles with our partner Companies us or (programme Data). 

If you have granted us a separate consent, we may also process and use those data within the scope of that consent, especially to send information and offers.

12. Termination

12.1 You may terminate the contractual relationship at any time without notice by deregistering from the programme via our website www.h-hotels.com. When termination takes effect, any unredeemed HotMiles will expire. You will be reminded of this consequence during the deregistration procedure.

12.2 We have the right to terminate the contractual relationship in writing at any time without reason by giving one months’ notice. HotMiles that are not redeemed before the termination will expire.

12.3 The right to termination for cause remains unaffected for both parties. We are particularly entitled to terminate for cause if you culpably breach these conditions of participation. If such a breach is committed, we may terminate only after a grace period set as a remedial action expires to no avail, unless the circumstances justify immediate termination of the contract after weighing reciprocal interests. If we effect extraordinary termination of the contract, unredeemed HotMiles will expire as soon as the termination is received, with immediate effect. 

12.4 If we declare termination for cause, we may block the account with immediate effect. After we declare extraordinary termination, the Company will no longer be eligible to participate in our HotMiles Business Events programme. The Company will not be permitted to apply again.

13. Changing the conditions of participation

We may adjust the conditions of participation to a reasonable extent if the legal situation or case law changes, or if the programme’s further development requires it, under consideration of the participants’ interests. We will notify you in text form of any amendments to these conditions of participation at least six weeks in advance. The amendments to the conditions of participation will be deemed accepted if you do not object to their application by the indicated date on which they will take effect. We will remind you of that consequence when we announce the amendment. The right to extraordinary termination in accordance with items 12.1 and 12.2 remains unaffected.

14. Applicable law

The law of the Federal Republic of Germany applies.
